California has several types of restraining orders designed to protect individuals from harassment, abuse, or violence.

Types of Restraining Orders in California

Domestic Violence Restraining Orders – DVRO:
These are issued when someone has been abused by a spouse or former spouse, a cohabitant or former cohabitant, a person with whom the victim has a child, or a current or former dating partner.

Civil Harassment Restraining Orders – CHRO:
These are for individuals who have been harassed, stalked, or abused by someone who is not close to them, such as a neighbor, roommate, or stranger.

Elder or Dependent Adult Abuse Restraining Orders:
These are for individuals who are 65 years of age or older, or who have certain disabilities, and have been abused or financially exploited.

    Workplace Violence Restraining Orders:
These are for individuals who have experienced violence, threats of violence, or harassment at their workplace.

Restraining orders typically prohibit the restrained person from contacting or coming near the protected person, their home, workplace, or children. They can also include other provisions depending on the circumstances, such as requiring the restrained person to move out of a shared home or to relinquish firearms.

To obtain a restraining order in California, you typically need to file a petition with the court and attend a hearing where you present evidence of the harassment or abuse. If the judge finds that there is a reasonable likelihood of harm, they can issue a temporary restraining order (TRO) until a full hearing can be held.

It’s important to note that violating a restraining order in California can result in serious legal consequences, including fines and imprisonment.
